A Chronology of Events Related to Roger's Situation

Legal Update May 20th 2008
Good News: The Federal Court has sent Roger's case back for State Court Review.
Had this not happened he very likely would have received an execution date.

Legal Update March 25th 2008

As of March 2008 Roger's case is in the US Federal District Court, for the Southern District of Texas where a writ of habeas corpus has been submitted.

With this appeal, Roger's Attorney has asked the Federal Court to return the case to the State Court system for review. This will allow him present new issues that are currently blocked due to procedural problems. Those issues were uncovered when Rogers friends funded the investigation of his case. But because those issues were not known earlier, they were not mentioned in his State Habeas appeal. Because they were not raised in State, they can not now be raised in the Federal courts. But if the case is returned to State Court, then a new State Appeal will be written which will include all of these issues.

These issues include Roger's actual innocence, and recently discovered information that the state appeared to have wrongfully withheld exculpatory evidence from Roger's trial attorneys.......
